Divorce/Matrimonial Law
Indian Divorce Act 1869
The Hindu Marriage Act contains provisions pertaining to marriages between Hindu men and women, including the dissolution of marriage, declaration of nullity, judicial separation, and custody of children born from the union. The act also covers remarriage and other provisions related to the settlement of a wife’s property, damages, and costs from an adulterer.
Hindu Marriage Act 1955
The act lays down rules and regulations governing the relationship between spouses and the children born from their cohabitation. According to the act, a Hindu man who is legally capable of entering into a contract may marry a female who is either unmarried, a widow, or a widower. Provisions for separation between spouses are also included in the act. Either party can file a divorce petition on grounds mentioned in the act. During the pendency of the petition, either party can request the court to grant legal expenses and monthly maintenance, as well as maintenance until remarriage. The act also covers the rights and responsibilities of spouses towards each other and their children.
Dowry Cases

IPC Section 406

Offenses under this section are non-bailable and cognizable. A person found guilty of committing criminal breach of trust may face imprisonment for a term of up to three years, or a fine, or both.
IPC Section 304B
The Indian Penal Code was amended in 1986 to include Section 304B, which outlines the crime of dowry death. The law specifies that if a woman dies within seven years of her marriage due to burns, bodily injury, or under abnormal circumstances, and if it can be established that she was subjected to cruelty or harassment by her husband or his relatives, in relation to a demand for dowry, then her death will be considered a “dowry death” and the husband or relative will be held responsible for causing her death.
The following is an explanation of this sub-section: The term “dowry” used in this section has the same meaning as defined in Section 2 of the Dowry Prohibition Act of 1961 (28 of 1961). Anyone who commits the offense of dowry death shall face imprisonment for a period of not less than seven years, which may extend to life imprisonment.

In the event of a cheque bounce, certain steps must be taken to resolve the matter:
